These acts allowed for special bank and civil service holidays, which were proclaimed by the Governor in Council and published in the Government Gazette. The Chief Secretary’s Department prepared and submitted the necessary documentation for these proclamations, including Melbourne Cup Day.

In 1873, the Chief Secretary James Goodall Francis approved a proposal to include Melbourne Cup Day as a special public holiday alongside the Prince of Wales’ birthday. This dual proclamation, however, drew some criticism. 

The Society for Promoting Morality expressed concern that a public holiday for the Cup would encourage gambling habits among young men. Despite this objection, Melbourne Cup Day continued to gain traction, and in 1875, the event was moved to the second Tuesday of November, aligning it with the Prince’s birthday and further solidifying its status as a significant day for the public.

In 1876, the Victorian Racing Club (VRC) requested that Melbourne Cup Day be moved to a Tuesday, with support from the Chief Secretary’s office. Over the following years, it became a tradition to proclaim a public holiday for the Cup, with annual proclamations gradually expanding its coverage. 

Finally, in 1993, the Public Holidays Act formally established Melbourne Cup Day as an official public holiday in Victoria, celebrated on the first Tuesday of November each year.
