Kah, captured in a photograph alongside a plate of white powder in June, expressed her unawareness of being filmed during the event. She revealed that she became aware of the circulating screenshots only hours before their publication in the media.

During the hearing, Kah stated, “I definitely was not aware that she (Ruby McIntyre) took a video. I don’t remember that video getting taken… if I remember it getting taken I would’ve stopped it. I did not see her filming. I got the screenshot of the video… that’s the first time I saw the video.”

Confronted with the compromising situation, Kah expressed her concern about the potential repercussions, stating, “I thought this is not a good look. I wanted to know who she sent the photos or video to. I still to this day don’t know how they got to the media.”

She added, “I believe she sent that video to someone and they screenshotted it and sent it around. I would’ve kicked her out (if I’d known) and been very upset that the video was taken.”

Kah emphasised that she had only recently met McIntyre hours before the incident and acknowledged that she had erred in placing trust in the stablehand. She also attributed her vulnerability to the influence of alcohol during that particular time.

The tribunal hearing aimed to shed light on the circumstances surrounding the incident and determine the responsible parties involved in the dissemination of the footage to the media.
