It was in an interview with Wilkinson that former Liberal staffer Brittany Higgins first alleged she had been raped inside Parliament House by a colleague.

Mr Lehmann was not named in the interview, though he claimed he was clearly identifiable to politicians and staffers who knew the pair.

Mr Lehrmann was eventually tried over the alleged crime, but the trial was later abandoned because of a juror's misconduct and there have been no findings against him.

He later launched defamation action against Wilkinson and Network Ten, as well as News Life Media and its journalist Samantha Maiden earlier this year.

Mr Lehrmann is also suing the ABC over a National Press Club address involving Ms Higgins.

Eventually, Mr Lehrmann settled with News Life Media and Maiden but is still pursuing Wilkinson and Network Ten.

A hearing for that case is set down in the Federal Court for November.

Wilkinson has had her own team of lawyers for the case, separate from those of Network Ten.

She is now taking action in the NSW Supreme Court, to force Network Ten to pay for her separate defence team.

The case has been listed for mention in the court on November 3.
